TERMS AND CONDITIONS

Welcome to the portfolio and services platform of Indrajit Auddy ("we," "our," "us"). By accessing our website, hiring us for software development services, or purchasing/renting game server hosting nodes (collectively, "Services"), you agree to be bound by the following Terms and Conditions. Please read them carefully.
1. GENERAL PROVISIONS
1.1 Eligibility
By utilizing our Services, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and possess the legal authority to enter into a binding contract. If you are accepting these Terms on behalf of an entity, you warrant that you have full authorization to bind that entity.
1.2 Account Security
To access server deployment options, cost billing ledgers, or contract updates, you must create a profile. You are solely responsible for protecting your credentials. Any unauthorized access to your account must be reported to us immediately.
2. SOFTWARE DEVELOPMENT SERVICES (Client Agreements)
The following terms govern custom software development, AI systems architecture, full-stack consulting, and contract engineering:
2.1 Scope of Work & Deliverables
All development projects are governed by separate project specifications, milestones, and timelines outlined in the mutually signed Statement of Work (SOW). Any additions or changes to the SOW will require a written change order.
2.2 Intellectual Property (IP) Rights
Pre-Existing IP: We retain all rights to pre-existing code, generic libraries, developer tools, and AI framework structures used to build your project.
Client Deliverables: Upon full receipt of payment, ownership of custom-built software components, assets, and custom source files developed specifically for the client under the SOW will be transferred to the client.
Developer Credit: We reserve the right to display project summaries, mockups, and non-sensitive case studies in our professional portfolio unless a signed Non-Disclosure Agreement (NDA) states otherwise.
2.3 Payments & Billing
Clients agree to pay project deposits and milestone invoices within the net terms defined in the project SOW. Late payments may result in immediate suspension of development, deployment, or support work.
3. GAME SERVER HOSTING SERVICES (Purchasers & Tenants)
The following terms govern the purchase, deployment, scaling, and maintenance of Minecraft and game server container nodes:
3.1 Provisioning & Resources
Resource Allocations: Game server instances are allocated CPU, RAM, and NVMe storage quotas depending on the pricing plan purchased (including custom sliders). Overuse of unauthorized processes or deliberate hypervisor abuse is strictly prohibited.
Server MOTDs and Content: You retain complete ownership of user-uploaded worlds, configuration scripts, and mods. You agree not to host content that is illegal, defamatory, or violates third-party intellectual property.
3.2 Performance & Downtime Disclaimers
Zero Lag / Lag Free: While our cloud node clusters are optimized to provide ultra-low latency, "zero lag" and "lag free" claims represent optimal server performance under normal load. Network routing conditions, player client mods, and third-party ISP performance are outside our control.
Maintenance: We reserve the right to perform scheduled security patches and system updates. We will make reasonable efforts to announce window reboots beforehand.
3.3 Payments, Top-ups, and Server Deletion
Wallet Balances: Deposits made to your account wallet are non-refundable and can only be used to purchase or renew server plans.
Billing Cycles: Hosting plans are billed on a recurring monthly cycle. If your wallet balance is insufficient at renewal, the server status will transition to suspended.
Server Deletion Policy: If a server instance remains unpaid or suspended for more than 2 consecutive months, we reserve the right to permanently terminate and hard-delete the server container and all its configuration data from our physical node drives.
4. ACCEPTABLE USE POLICY (AUP)
You agree not to use the platform, software deliverables, or game server nodes to:
Conduct scanning, probing, or vulnerability testing of our infrastructure.
Execute denial of service (DoS) attacks, cryptomining scripts, spam mailers, or port scans.
Infringe upon the privacy or intellectual property rights of others.
We reserve the right to immediately terminate or suspend access to any server or client portal that violates this policy, without prior notice or refund liability.
5. DISCLAIMER OF WARRANTIES
ALL SERVICES AND DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OF THE PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
7. AMENDMENTS
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted to the website and the "Last Updated" date will reflect the revision. Continued use of our software development or hosting services after changes are posted constitutes your acceptance of the revised Terms.
